1 - SCOPE OF APPLICATION

These Terms and Conditions establish the conditions applicable to transactions carried out by SoSexy Romance Store and its Buyers, and regulate the rights and obligations of the parties, prevailing over any non-mandatory legal provisions.

 Browsing the website www.sosexy.com.pt, as well as purchasing any product, implies acceptance of these Terms and Conditions.

 SoSexy may, at any time, change, in whole or in part, the Terms and Conditions set out here.

Such modifications are binding for users as of their publication online. It is therefore recommended that users regularly consult the conditions of use to be aware of any changes.

Buyers must be over 18 years of age and aware that the items for sale on the SoSexy website are intended exclusively for adults.

SoSexy is not responsible for damages or losses that may arise from the use of any information contained on this site.

2 - TERM AND AMENDMENTS TO THE AGREEMENT

Requests for changes to previously placed orders must always be made in writing to our email livreessencia@gmail.com

These change requests may not be accepted if the ordered items have already been shipped to the customer.

3 - PRODUCT

SoSexy sells erotic products with exclusive content for adults, permitted in accordance with the legislation in force (Decree-Law n.º 254/76 of April 7, amended by Decree-Law n.º 653/76 of July 31 and Decree -Law n.º 174/2012 of 2 August revoked by Decree-Law n.º 10/2015 with the exception of article 3).

 
Products duly identified in the catalogs can be purchased on the SoSexy website.

The selection of the products subject to the transaction, as well as their use, function or destination, are the sole responsibility of the Buyer.

4 - SUPPLY

The Buyer is obliged to place the order through the SoSexy website.

To do so, you must register in the "CREATE ACCOUNT" field, indicating all the information requested for this purpose.

The registration of the Customer and/or order does not exempt the reading and acceptance of these Terms and Conditions.

When placing an order through the SoSexy website, the Buyer expresses his full and complete acceptance of the general conditions of sale, prices and description of the products contemplated in the transaction.

5 – TRANSPORTATION

The available delivery and/or transport methods are:

a) Personal collection (situation in which the Buyer personally goes to SoSexy's physical store, in Matosinhos, or entrusts another person, at his own expense, to collect the products);

b) Delivery through the transport indicated by SoSexy.

In the event that the Buyer chooses to send the products through SoSexy's carrier, the transport price and the delivery time for the same are calculated automatically on the website so that the Buyer is immediately aware of the shipping costs and the delivery time.

6 - DISPATCH NOTIFICATION AND INVOICE

After completing the order, and depending on the payment method chosen, SoSexy issues and sends the invoice to the Buyer.

The delivery time for the ordered products is indicated on the website at the conclusion of the purchase process.

The deadline is merely indicative, and never binding, and for this reason, SoSexy is not liable for any delivery of the item after the initially indicated deadline.

7 – FORCE MAJEURE ON DELIVERY

SoSexy will not be responsible for any delays in deliveries in the event of force majeure, non-culpable interruptions in business activity, situations of disorder, war, natural disasters, government measures and other unavoidable events, while such circumstances persist.

 This provision is also applicable in the event of a labor dispute.

8 - PRICES

All products are priced in Euros (€), including the current VAT rate, and are only valid for online purchases.

SoSexy does not guarantee that the values of the products sold on this site coincide with those of the physical store and vice versa, thus considering themselves to be different stores.

In this way, SoSexy is not obliged to practice online prices in physical stores and vice versa.

Discounted products are duly identified, indicating the value without discount, the percentage of the discount and the final value calculated with the price reduction.

9 - PAYMENT TERMS

SoSexy offers the following payment methods:

•         by Multibanco
•         by MbWay;
•         by Bank transfer ;
•         by Hipay (visa or mastercard credit cards)

10 – WARRANTY

All products are sold with the quality they have and in the state in which they are found on the date of sale.

 The Buyer must check that the goods are free of defects, correct and complete upon receipt.

11 – PRIVACY

We are committed to protecting your privacy and that of other users.

12 – TITULARITY AND INTELLECTUAL/INDUSTRIAL PROPERTY

All rights related to SoSexy, including all intellectual/industrial property rights, such as trade names, brands and distinctive signs, its graphics, codes and computer programs are the property of Livre Essência Unip. Ltd.

Occasionally, Intellectual/Industrial Property Rights of third parties may be used, subject to their authorization.

Any reproduction, distribution, commercialization, alteration and/or transformation of contents that has not been expressly authorized by Livre Essência Unip. Lda. is expressly prohibited and/or by third parties, holders of the respective intellectual/industrial property rights.

13 – PROTECTION OF PERSONAL DATA

The personal data entered on the SoSexy website are protected under Regulation (EU) 2016/2017 of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons with regard to data processing. personal data and the free movement of such data and repealing Directive 95/46/CE (General Data Protection Regulation).

Under the terms of the Law, the Client is guaranteed the Right of access, rectification and erasure of personal data. Right to limit processing, right to oppose processing and right to portability of personal data. – See Privacy and Transparency Policy.

14 - COMPETENT JURISDICTION

For all issues arising from this contract, the Court of the District of Matosinhos is competent.
